LIMITED MANUFACTURER’S WARRANTY (USA)

Applies to products purchased in the United States of America
 

1. What This Warranty Is
This is a limited warranty. Nextbase warrants that, during the applicable warranty period, the product will be free from defects in materials and workmanship under normal use.

If a covered defect arises during the warranty period, Nextbase will, at its option and acting reasonably, do one of the following:
•   Repair the product
•   Replace the product with the same or a comparable model
•   Refund the purchase price, where repair or replacement is not commercially reasonable or where required by applicable law. (see Section 6)

This is a return-to-service warranty, meaning the product must be returned to Nextbase or an authorized service provider for evaluation.

2. Who This Warranty Covers
This warranty applies to the original consumer purchaser who purchased the product new in the United States of America for personal, household, or private use.

This warranty does not apply to products purchased primarily for commercial, rental, or resale purposes, except where consumer protections apply by law.

 3. Where This Warranty Applies
This warranty applies only to products:
•   Purchased in the United States of America, and
•   Purchased from:
    - Nextbase’s official online store, or
    - An authorized Nextbase retailer or distributor in the United States of America
 

4. Warranty Period
The warranty period starts on the date of original retail purchase.

Product Type   Warranty Period
Dashcams and Rear Cameras - 12 months
Accessories (mounts, cables, cases, etc.) - 6 months
Rechargeable batteries, Sticky Pads, SD Cards - 3 months

5. What This Warranty Does NOT Cover
This warranty does not cover damage or defects caused by:
•   Normal wear and tear
•   Accidental damage, misuse, abuse, or neglect
•   Improper installation, storage, or operation
•   Use of non-approved accessories or power supplies
•   Unauthorized modification or repair
•   Acts of nature (including fire, flood, or power surges)

5.1. Data Loss
Nextbase is not responsible for loss or corruption of data stored on the product.
You are responsible for backing up all data before sending a product for service.

6. Remedies by Time Since Purchase
6.1. Claims Made Within 30 Days of Purchase
If your claim is approved, Nextbase may provide:
•   A full refund of the purchase price (and standard delivery charges, if applicable), or
•   A replacement product
Refunds may be reduced if components or accessories are missing or if customer-caused damage is identified.

6.2. Claims Made After 30 Days (Up to Warranty Expiry)
If the claim is approved, we will:
•   Repair the product, or
•   Replace it with the same or a comparable model
Refunds are not available after 30 days unless required by law.
Repaired or replacement products continue under the remaining original warranty period.

7. Display Pixel Characteristics (Not a Defect)
LCD panels may experience pixel failures over time.

A single pixel failure per year of operation is considered normal and not a defect under this warranty. Claims within this tolerance will not be covered.

This provision does not limit any rights you may have under applicable consumer protection laws.

8. How to Make a Warranty Claim
1.   Keep your proof of purchase.
2.   Contact Nextbase customer support to report the issue.
3.   Follow the instructions provided for return or service.

You may be required to ship the product to an authorized service center. Shipping terms will be provided during the claim process.

9. Implied Warranties
To the extent permitted by law, any implied warranties, including the implied warranties of merchantability and fitness for a particular purpose, are limited in duration to the length of this Limited Warranty.

Some states do not allow limitations on how long an implied warranty lasts, so this limitation may not apply to you.

10. Limitation of Liability
To the extent permitted by law:
•   Nextbase is not liable for incidental, indirect, or consequential damages, including loss of data, loss of profits, or loss of use.
•   Our total liability under this warranty will not exceed the purchase price paid for the product.

Some states do not allow the exclusion or limitation of incidental or consequential damages, so these limitations may not apply to you.

We do not exclude or limit liability for:
•   Death or personal injury caused by negligence
•   Fraud or fraudulent misrepresentation
•   Any liability that cannot be excluded under applicable law
If the limited remedy fails of its essential purpose, Nextbase may provide an alternative remedy as required by applicable law.

11. Governing Law
Except where a state-specific rider applies, this warranty is governed by the laws of the U.S. state in which the product was purchased, without regard to conflict of law principles.

This warranty gives you specific legal rights, and you may also have other rights that vary from state to state.

If you reside in one of the following states, the terms in this Rider apply in addition to the main Limited Warranty Terms. Where there is a conflict, this Rider controls.

CA-1. Implied Warranties (California Notice)
Under California law, implied warranties of merchantability and fitness for a particular purpose cannot be disclaimed.
These implied warranties are limited to the duration of this express warranty, unless otherwise required by law.

CA-2. Limitation of Liability
To the extent permitted by California law:
•   Nextbase is not responsible for incidental or consequential damages, including loss of data, loss of profits, or loss of use.
Some exclusions or limitations may not apply to you under California law.
Nextbase does not exclude or limit liability for:
•   Death or personal injury caused by negligence
•   Fraud or fraudulent misrepresentation
•   Any liability that cannot legally be excluded
