What this Warranty Does NOT Cover
NEXTBASE U.S. WARRANTY & SERVICE CONTRACT TERMS IMPORTANT CONSUMER NOTICE (U.S.)
This document contains important information about your warranty rights under federal and state law. This warranty gives you specific legal rights, and you may also have other rights that vary from state to state.
Nothing in this document limits or excludes rights you may have under applicable U.S. federal or state law.
COVERAGE OVERVIEW (UP TO 3 YEARS TOTAL COVERAGE)
Nextbase provides a Standard Limited Warranty with all eligible products. Additional coverage may be available through optional Service Contracts, promotional programs, or subscriptions, as described below.
Total coverage duration depends on the product and the type of additional coverage selected or activated.

Service Contract Is Not a Warranty.
Coverage beyond the Standard Limited Warranty is provided by a Service Contract, which is:
• Optional
• Separately regulated under state law
• Subject to its own terms and conditions
Road Safety Club (Promotional Coverage)
• Available only to eligible products and users
• Requires active participation and consent
• Coverage ends if participation ends
Where required by law, any benefit provided is reasonably related to the value of data shared.
Protect Subscription Coverage
• Available only for eligible models
• Coverage is active only while subscription is active
• Subject to billing and renewal terms disclosed in the app

Availability Disclosure
Not all coverage options are available for all products. Availability is:

1. DEFINITIONS
“Standard Limited Warranty” means the limited manufacturer’s warranty provided at no charge with the purchase of a Nextbase dash cam.
“Standard Warranty Period” means twelve (12) months from the original retail purchase date.
“Service Contract” A separate, optional agreement (which may be paid, included with a subscription, or provided as part of a promotional program) that provides additional coverage after or alongside the Standard Limited Warranty. A Service Contract is not a warranty.
“Service Contract Period” means one (1) or two (2) additional years of coverage, as selected or disclosed at purchase or enrolment.
“Road Safety Club” means a voluntary opt-in program under which customers may choose to share limited dash cam video data subject to applicable privacy laws and user consent. Video data is shared only with vetted partners under contractual restrictions prohibiting resale or secondary use.
“Protect Subscription” means, A paid subscription service offered via the Nextbase app that may include Service Contract benefits
2. ABOUT US
This Warranty and where applicable Service Contract are provided by Portable Multimedia Limited, trading as Nextbase (“Nextbase,” “we,” “us,” or “our”).

3. STANDARD LIMITED WARRANTY
3.1. Nature of Warranty
This is a LIMITED WARRANTY under the Magnuson-Moss Warranty Act.
3.2. What Is Covered
During the Standard Warranty Period, Nextbase warrants that the dash cam will be free from defects in materials and workmanship under normal consumer use.
3.3. What We Will Do
If a defect covered by this warranty arises, Nextbase will, at its option:
• Repair the product, or
• Replace it with a new or refurbished product of equal or greater value.
3.4. What Is Not Covered
This warranty does not cover:
• Normal wear and tear
• Cosmetic damage
• Damage caused by misuse, accident, improper installation, or modification
• Damage caused by external power sources or accessories unless the supplied accessory caused the defect
• Consumable items such as adhesive mounts, batteries or SD cards unless required by law
Use of third-party accessories does NOT void this warranty unless the accessory directly caused the defect.
3.5 Implied Warranties
To the extent permitted by law, any implied warranties are limited in duration to the Standard Warranty Period. Some states do not allow such limitations, so this may not apply to you.
4. SERVICE CONTRACT (GENERAL TERMS)
4.1. Nature of Coverage
A Service Contract is not a warranty and is regulated separately under state law. It is a separate agreement that may provide repair or replacement services.
4.2. Coverage
Unless otherwise stated, Service Contracts provide coverage similar to the Standard Limited Warranty.
4.3. Purchase Eligibility
Service Contracts must be purchased or activated within the timeframe disclosed at the time of sale, unless otherwise required by law.
4.4. Cancellation
You may cancel the Service Contract:
• Within 30 days of purchase for a full refund (less any benefits paid or costs incurred under the Service Contract, as permitted by applicable state law.)
• After 30 days, for a prorated refund of the unexpired term, as required by state law
Some states provide additional cancellation rights.
5. ROAD SAFETY CLUB (PROMOTIONAL SERVICE CONTRACT)
5.1 Voluntary Program
Participation is entirely voluntary and requires user consent.
5.2 Benefit
Eligible participants may receive a no-charge Service Contract during active participation.
5.1. Coverage
While enrolled in Road Safety Club, eligible customers receive a no-charge service contract providing coverage equivalent to the Service Contract.
5.2. Data Use & Consent
Participation requires consent to share limited video data in accordance with:
• Our Privacy Policy
• Applicable U.S. state privacy laws (including CCPA/CPRA where applicable)
5.4 Effect of Withdrawal
You may withdraw consent at any time. If you withdraw from the program, associated Service Contract benefits will end.
Where required by law, this program is structured so that any benefits provided are reasonably related to the value of the data shared.
6. PROTECT SUBSCRIPTION (APP-BASED)
6.1 Coverage
A Service Contract may be included as a benefit of a paid Protect Subscription.
6.2. Eligibility
Customers who own dashcams that offer the Protect or Protect Plus subscription
- Protect is available to Piqo 1K and Piqo 2K owners
- Protect and Protect+ is available to iQ1K, iQ2K and iQ4K owners.
6.3. Coverage
The Subscription Service Contract provides the same coverage and remedies as the Standard Limited Warranty.
6.4 Billing & Cancellation
• Subscriptions renew automatically unless cancelled
• You may cancel at any time via your Nextbase App
• Benefits continue through the current billing period unless required otherwise by law
7. SCOPE AND DURATION OF SERVICE CONTRACT COVERAGE
Service Contracts do not cover:
• Normal wear and tear
• Cosmetic damage
• Misuse, improper installation, or modification
• Unauthorized repairs
• External causes beyond our control
Repairs & Replacement
• Products may need to be returned for service
• Nextbase will cover return shipping to the customer
• Customer shipping responsibilities will be disclosed at time of claim, except where prohibited by law
Replacement Limits
Replacement may be limited to reasonable circumstances, except where prohibited by law.
8. LIMITATIONS OF LIABILITY
8.1 Remedy Limitation
Repair or replacement is the primary remedy under this Limited Warranty and any Service Contract, except where prohibited by law or where such remedy fails of its essential purpose.
8.2 Damages
To the extent permitted by law, Nextbase is not liable for incidental or consequential damages. Some states do not allow this limitation.
8.3 Liability Cap
To the extent permitted by law, liability will not exceed the amount paid for the product or Service Contract.
9. NON-EXCLUDABLE RIGHTS
Nothing in this document limits or excludes liability for:
• Death or personal injury caused by negligence
• Fraud or fraudulent misrepresentation
• Rights under product liability laws
• Any rights that cannot be waived under law
10. TRANSFERABILITY
This warranty and any service contract apply only to the original purchaser and are not transferable, except where required by state law.
11. GOVERNING LAW (U.S.)
This agreement is governed by the laws of the state in which the product was purchased, without regard to conflict-of-law principles.
In case of translation issues, the language in the English version of this document shall be the master to the extent permitted by law.
12. EVENTS OUTSIDE OUR CONTROL
12.1. A Force Majeure Event includes any act, event, non-happening, omission or accident beyond our reasonable control and includes in particular (without limitation) the following:
• strikes, lockouts or other industrial action.
• civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war.
• fire, explosion, storm, flood, earthquake, subsidence, epidemic or pandemic or other natural disaster.
• impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport.
• impossibility of the use of public or private telecommunications networks; and
• The acts, decrees, legislation, regulations or restrictions of any government.
12.2. Our performance under this contract is deemed to be suspended for the period that the Force Majeure Event continues, and we will have an extension of time for performance for the duration of that period. We will use our reasonable endeavours to bring the Force Majeure Event to a close or to find a solution by which our obligations under this contract may be performed despite the Force Majeure Event.
13. WAIVER
13.1. If we fail, at any time during the term of this contract, to insist upon strict performance of any of your obligations under this contract or any of these terms and conditions, or if we fail to exercise any of the rights or remedies to which we are entitled under this contract, this will not constitute a waiver of such rights or remedies and will not relieve you from compliance with such obligations.
13.2. A waiver by us of any default will not constitute a waiver of any subsequent default.
13.3. No waiver by us of any of these terms and conditions will be effective unless it is expressly stated to be a waiver and is communicated to you.
14. SEVERABILITY
14.1. If any of these terms and conditions are determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term, condition or provision will to that extent be severed from the remaining terms, conditions and provisions which will continue to be valid to the fullest extent permitted by law.
15. ENTIRE AGREEMENT
15.1. These terms and conditions and any document expressly referred to in them constitute the whole agreement between us and supersede all previous discussions, correspondence, negotiations, previous arrangement, understanding or agreement between us relating to the subject matter of this contract.
15.2. We each acknowledge that, in entering into this contract, neither of us relies on any representation or warranty (whether made innocently or negligently) that is not set out in these terms and conditions or the documents referred to in them.
15.3. Each of us agrees that our only liability in respect of those representations and warranties that are set out in these terms and conditions (whether made innocently or negligently) will be for breach of contract.
15.4. We intend to rely upon these terms and conditions and any document expressly referred to in them in relation to the subject matter of this contract. While we accept responsibility for statements and representations made by our duly authorised agents, please make sure you ask for any variations from these terms and conditions to be confirmed in writing.
16. VARIATION TO THESE TERMS AND CONDITIONS
16.1. We may vary these terms and conditions from time to time provided that such changes do not materially affect the nature and quality of the warranty provided hereunder. Any such changes will be notified to you as soon as is reasonably practicable.
17. DISPUTE RESOLUTION
If you have a dispute, please contact customer support first. If unresolved, disputes may be resolved through:
• Small claims court (where eligible), or
• Arbitration is optional and will not apply unless both parties agree or applicable law requires it.
You are not required to waive statutory consumer rights.

18. STATE LAW NOTICE
Some states do not allow limitations on:
• Duration of implied warranties
• Incidental or consequential damages
• Cancellation rights
Accordingly, certain limitations may not apply to you.
19. STATE-SPECIFIC RIGHTS
If you reside in a state with specific Service Contract regulations, additional rights may apply. Where required, state-specific provisions will control over conflicting terms.

If you reside in one of the following states, the terms in this Rider apply in addition to the main U.S. Warranty & Service Contract Terms. Where there is a conflict, this Rider controls.
CALIFORNIA SERVICE CONTRACT RIDER
Cancellation Rights (California)
If you are a California resident, you may cancel this service contract:
• Within 30 days of purchase for a full refund, provided no claim has been made; or
• After 30 days, at any time, for a pro-rata refund of the unearned portion of the contract price, less any benefits paid.
Refunds will be issued within 30 days of receipt of your cancellation request.
Service Contract Regulation
This service contract is issued and administered in accordance with applicable provisions of California law, including the Song-Beverly Consumer Warranty Act.
Consequential Damages
California law does not allow limitations on certain damages. Any limitation that is not permitted under California law does not apply to you.
FLORIDA SERVICE CONTRACT RIDER
Regulatory Disclosure
This service contract is issued and administered in compliance with Florida Statutes Chapter 634.
The obligor under this service contract is:
Portable Multimedia Limited (Nextbase)
Cancellation Rights (Florida)
You may cancel this service contract:
• Within 30 days of purchase for a full refund, less any benefits paid or costs incurred under the Service Contract, as permitted by applicable state law. or
• After 30 days, for a pro-rata refund of the unexpired term, less the cost of any claims paid.
Claims Administration
Claims will be handled directly by Nextbase or its authorized service administrators.
NEW YORK SERVICE CONTRACT RIDER
Cancellation Rights (New York)
If you are a New York resident, you may cancel this service contract:
• Within 20 days of receipt (or 10 days if delivered at the point of sale) for a full refund, provided no claim has been made; or
• At any time thereafter for a pro-rata refund of the unearned portion of the contract price, less any claims paid.
Refunds will be processed within 30 days of cancellation.
Transferability
New York law may permit transfer of service contracts in certain circumstances. To the extent required by law, this contract may be transferred upon sale of the covered product.
Governing Law
This service contract is governed by the laws of the State of New York.
TEXAS SERVICE CONTRACT RIDER
Regulatory Disclosure
This service contract is governed by Texas Occupations Code Chapter 1304.
Cancellation Rights (Texas)
You may cancel this service contract:
• Within 30 days of purchase for a full refund, less any benefits paid or costs incurred under the Service Contract, as permitted by applicable state law. or
• After 30 days, for a pro-rata refund of the unearned contract price, less any benefits paid.
No Reduction of Implied Rights
Texas law provides certain implied warranties and consumer protections that cannot be waived. Nothing in this service contract limits those rights.
ROAD SAFETY CLUB – STATE PRIVACY NOTICE (CA & TX HIGHLIGHT)
California Privacy Rights
California residents have the right to:
• Know what personal data is collected
• Opt out of certain data sharing
• Withdraw consent without penalty
Withdrawing consent will not affect your Standard Limited Warranty.
Texas Privacy Notice
Texas residents’ personal data will be processed in accordance with applicable Texas and federal privacy laws. Participation in Road Safety Club is voluntary and may be terminated at any time.
